California’s Third District Court of Appeal has granted a stay of a recent Superior Court injunction that ordered CDFA to suspend chemical activities for pest control and eradication that rely on the Statewide Plant Pest Prevention and Management Program Environmental Impact Report (PEIR) for compliance with the California Environmental Quality Act (CEQA). The stay allows CDFA’s plant pest prevention programs to rely on the PEIR for CEQA compliance while the Superior Court decision and injunction are appealed.

CDFA prepared the PEIR to provide an up-to-date, transparent, and comprehensive environmental evaluation of CDFA’s plant pest prevention activities. Legal challenges were filed shortly after the Final PEIR was certified, and the case is currently at the Appeals Court level.
